Hydrofracturing used to produce natural gas from the ground are serious and, as yet, not remedied by companies drilling in Texas lands.

A Major problem is polluted Water

A federal panel recently stated that there is a significant risk with "flowback". This is caused by tremendous amounts of water, contaminated with toxins, brought to the surface with the natural gas. Many times this is stored on the landowner's property. Not only is this a detriment to the value of the property, but also there is no known safe way to store such toxins.

No Effective Regulations in Hydrofracturing Procedures

To date, there are no effective regulations or adequate federal workforce to protect the landowners who, in good faith, leased out the right to drill on their family's property.

Some wells are causing underground leaks of chemicals and methane gas

Recently the Enviromental protection agency disclosed that some wells are causing Underground Leaks of chemicals and Methane gas. This contamination is sometimes caused or enhanced by poor cement well casings that allow fracking fluids such as nitrogen, carbon dioxide, gels, foams, silica sand, resin coated sand, ceramics, sand with naturally radioactive minerals (to measure the fracture trace), chemical compound, acid and methane to escape all the way up the pipe to groundwater levels.

United States Geological Survey re-established a project study

Disturbingly, the United States Geological Survey had re-established a project to study the induced "Seismicity" in response to the string of suspicious earthquakes in shale-gas areas.

Oil and Gas Companies Have a Duty To Restore the Land

Oil and Gas companies have a duty to restore the land when production is over, yet some companies put language in their contracts that tries to revoke or significantly limits this duty. Such language in a contract should not be enforcable

Hydrofracturing Land Lease Clauses

Many leases have a clause that allow the company to use the land to store gas or drilling waste on or under the landowner's property from wells on the the property and wells from other locations. The clauses can take the form of "conversion to storage" clauses, "disposal and injected well" clauses, or both. Newer leases often allow the company to drill a new well and re-enter older wells for the disposal of toxins These leases should be challenged as unenforceable.

Leases often Ignore Federal Laws

Leases often ignore federal laws requiring that the company explain potential environmental risks involved in the drilling.

Many provisions in the leases should not be held up by a court because of the unequal bargaining position of a company dealing with an unrepresented individual. They call it a " contract of adhesion"

Fracking exmpted from the requirements of the Safe Drinking Water Act

Did you know Fracking has been exempted from the requirements of the Safe Drinking Water Act, The Clean Air Act, and the Clean Water Act. This is being called the "Halliburton Loophole". The companies doing the fracking don't have to report what chemicals are being used but it is known that the chemicals include Benzene, Toluene, Boric Acid , Xylene, Diesel-Range Organics , Methanol, Formaldehyde and Ammonium Bisulfate

It takes 8 million gallons of water and chemicals to frack a well

Do you know it takes 8 million gallons of water and chemicals to frack a well and that might happen as much as 18 times at one well. Half of this Fracking Fluid, (now called "wastewater"), comes back to the surface. Much of that is reinjected in old wells or stored in surface pits that have a bad repuation for leakage. These procedures are hidden in hydrofracturing lease agreements with landowners. Again, such extreme provisions should not be enforcable.
